JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-03-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 323,341,325,148,149,307 and 379 of the Indian Penal Code. The prosecution case is that on 11.12.2015 when the informant was at his door, the accused persons came variously armed and started working on the land of the informant. On protest being made, on the order of Niranjan Singh, Subodh assaulted on the head of the informant with lathi. Petitioner no. 1 Niranjan assaulted with Khanti on the head of the informant, petitioner no. 2 assaulted with belcha over the head of the brother of the informant and petitioner no. 4 Kaju Kumar assaulted with brick on the chest of the informant's father.

No.14190 of 2016 (2) dt.31-03-2016 2/2 It is submitted by the learned counsel for the petitioners that one injury of the informant on his scalp has been found to be simple whereas injured Indradeo Singh received one lacerated injury on the forehead and the other is pain on chest though opinion with regard to the nature of injury has been kept reserved. It is further submitted that one person was killed from the petitioners side.

Considering the fact that one person was killed from the petitioners side and injury caused to the informant side has been found to be superficial simple in nature, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai in connection with Ballia P.S. Case No.394 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
