====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 22-05-2017 Heard the learned counsel, Mr. Rajendra Kishore Prasad, for the petitioner.

Perused the impugned order dated 06.04.2013 passed by learned Munsif, Raxaul in Title Suit No.18 of 2001 whereby the learned Court below has rejected the application filed by the defendant petitioner praying for reexamination of his signature and writing with the disputed signature and writing occurring in the Mahadnama.

From perusal of the impugned order, it appears that the trial Court found that at the instance of the present petitioner itself earlier disputed signature and the signature and writing of this petitioner has already been examined by the Government expert and report has already been submitted. In such view of the matter, I do not find any reason to allow for further second report and thus there is no jurisdictional error in the impugned order passed by the trial Court.
