The petitioner seeks bail in anticipation of his arrest in connection with Dalsingsarai P.S. Case No. 369 of 2018 dated 09.12.2018 instituted for the offences under Sections 147, 225-A,225-B, 224, 225, 323, 332, 341 and 353 of the Indian Penal Code.
One Basudeo Rai, an accused of a criminal case was arrested by the police and the petitioner and others are alleged to have managed to take him away from the captivity of the police.
Though the petitioner has been named in the FIR but nothing specific has been alleged against him. Several accused persons have been made accused in this case and the implication of the petitioner
Patna High Court CR. MISC. No.14145 of 2019(2) dt.08-03-2019 2/2 is on the basis of some persons of the village inimical to him having provided his name to the police.
Regard being had to the aforesaid facts and the clean antecedents of the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Samastipur in connection with Dalsingsarai P.S. Case No. 369 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
