JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-03-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 15.11.2017 passed in Cr.Misc.No.53618 of 2017 with liberty to the petitioner to renew his prayer for bail before the court below on examination of prosecutrix in court.
Submission of learned counsel for the petitioner is that the prosecutrix has been examined in the trial court as an witness and she has not supported the prosecution case stating that petitioner has not done any wrongful act with her and petitioner is in custody since 22.8.2017.

Having heard both sides and in the facts and circumstances, let the petitioner, above named, be released on bail
Patna High Court Cr.Misc. No.14829 of 2018 (2) dt.21-03-2018 2/2 on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the District and Sessions Judge, Darbhanga, in connection with Sessions Trial Case No. 494 of 2017, arising out of Simri P.S.Case No. 98 of 2017, subject to the conditions that
(1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and (2) petitioner shall co-operate in trial and appear before the court as and when required, except on genuine ground, failing which his bail bond shall be cancelled.
