JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 11-07-2019 This court is not required to go into the merit of the case as it has been informed to this court that now the Waqf Tribunal constituted in accordance with the Section 83 of the

Patna High Court CWJC No.4747 of 2019(2) dt.11-07-2019 2/2 Waqf Act, 1995 is functioning. It is not in dispute that the shop in question is a Waqf property.

This writ application is, thus, disposed of with liberty to the petitioner to move an appropriate application before the Tribunal under the Waqf Act, and if such an application is preferred within 30 days from today, the same will be considered by the Tribunal on it's own merit. In case, any question of limitation arises for consideration the same will be considered keeping in mind that petitioner was pursuing his remedy before this court.
