JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-08-2017 This appeal has been filed for grant of bail in connection with Special (SC/ST) Case No. 95 of 2017, arising out of Narpatganj P.S.Case No. 87 of 2017, G.R.No. 641 of 2017, registered under Sections 307 504, 506 and other sections of the Indian Penal Code and 3(i)®, 3(2)(v) of SC/ST Act and for setting aside the impugned order dated 17.4.2017 passed by 1st Additional Sessions Judge-cum-Special Judge, SC/ST Act, Araria. Allegation as per FIR is that when police came to apprehend the appellant he along with several accused persons confined the police personnel and also causing injuries to them. Submission of learned counsel for the appellant is that there is general and omnibus allegation and no specific allegation is attributed to the appellant and he is in custody since 31.3.2017.

Patna High Court CR. APP (SJ) No.1746 of 2017 (4) dt.25-08-2017 2/2 Heard learned Special P.P., who has opposed the prayer for bail on the ground that appellant is the main accused and the appellant along with others has caused injuries to police personnel and appellant has criminal antecedents also.

Having heard both sides and in view of above facts and circumstances, I am not inclined to grant bail to the appellant at this stage.

However, appellant may renew his prayer for bail after framing of charge in this case.
