Manoj Kumar Singh, Advocate, learned counsel Sri. Bharat Lal appearing for the State of Bihar through Video Conferencing.

Petitioner seeks bail in connection with N.D.P.S. Case No. 64 of 2019 arising out of Palanwa P.S. Case No. 100 of 2019 registered for the offences punishable under Sections 20 and 22 of the N.D.P.S. Act, 1985. 4.5 kg Ganja is said to have been recovered from the possession of the petitioner for which petitioner is in jail custody since 15.09.2019 without having any criminal antecedent.

Patna High Court CR. MISC. No.13929 of 2020(2) dt.11-06-2020 2/2 Admittedly, the alleged recovery does not come under the ambit of commercial quantity and the alleged recovery is much below the ambit of commercial quantity.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge cum Special Judge, East Champaran, Motihari in connection with N.D.P.S. Case No. 64 of 2019 arising out of Palanwa P.S. Case No. 100 of 2019.
