Allegation against the petitioner is of firing on the informant causing grievous injury and earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 19.06.2017 passed in Cr. Misc. No.19990 of 2017. Submission of the learned counsel for the petitioner is that he is in custody since 3.7.2015 and up-till-now, the case has not been committed to the court of sessions.
Heard learned A.P.P. also.
Having heard both sides and in view of period of custody, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with
Patna High Court Cr.Misc. No.21290 of 2018 (2) dt.19-04-2018 2/2 two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Saharsa in connection with Mahishi P.S.Case No.8 of 2015 with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled. With the aforesaid observation, this application is allowed.
