====================================================== CORAM: HONOURABLE MR. JUSTICE KHATIM REZA ORAL ORDER 24-08-2022 Heard Mr. Ramakant Sharma, learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State.

Let the defect (s), as pointed out by the office, be removed within a period of four weeks from today. The petitioner seeks bail in connection with a case registered for the offences punishable under Sections 341, 441, 307, 325, 326, 504, 506 and 120(B) of the Indian Penal Code. As per the prosecution case, informant alleges that Manoj Kumar (petitioner) along with four accused persons assaulted the informant's son with iron rod due to which, the left eye of his son was damaged.

Learned counsel for the petitioner submits that the

Further, it is submitted that there is no specific overt act attributed against the petitioner and there is general and omnibus allegation levelled against the petitioner. It is submitted that the informant has also filed protest-cumcomplaint before the A.C.J.M-1st, Patna City wherein he did not allege specific overtact against the petitioner and his family members. It is further submitted that the petitioner is in custody since 19.12.2021, is a person with clean antecedent and chargesheet has been submitted in the case. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) only with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., 1st, Patna City in connection with Fatuha P.S. Case No. 330 of 2021.
