JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-03-2019 This is an application for grant of anticipatory bail in connection with Sahar P.S. Case No. 263 of 2018, disclosing offences under Section 30(a), 36, 37(b) of the Bihar Prohibition and Excise Act 2016.

Allegation is of recovery of 60 liters country made liquor from the bank of river and four persons were arrested and one of them has disclosed the names of the petitioners as their associates.

Submission of learned counsel for the petitioners is that except confessional statement of one co-accused person there is absolutely nothing against the petitioners and they have no criminal antecedents.

Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge, Excise, Bhojpur, Ara, in connection with Sahar P.S. Case No. 263 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
