JUSTICE ARUN KUMAR ORAL ORDER 26-03-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody since 26.06.2017, seeks bail in connection with Laxmipur P.S.Case No. 115 of 2017 registered under Sections 399 and 402 of the Indian penal Code and Sections 25(1-B)a, 26 and 35 of the Arms Act and Sections 3 and 4 of the Explosive Substance Act.

Allegation in brief is that on information received, police intercepted a vehicle wherein some persons were moving with arms and several arms were recovered and it alleged that from the possession of the petitioner, one loaded country made pistol with two detonators were recovered from his possession. Submission is that other co-accused persons from whose possession arms as well as cane bomb were recovered have been admitted to bail by a co-ordinate Bench of this court vide order

Patna High Court Cr.Misc. No.16538 of 2018 (2) dt.26-03-2018 2/2 dated 30.11.2017 and 12.02.2018 passed in Cr. Misc. No. 55568 of 2017 and Cr. Misc. No. 3564 of 2018 respectively. Having considered the aforesaid facts and circumstances, the petitioner, namely, Ashok Yadav, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM-III, Jamui in connection with Laxmipur P.S. Case No. 115 of 2017 with condition that one of the bailor must be his close family member. Petitioner shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any reasonable cause, his bail bond shall be liable to be cancelled.
