JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-03-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 6.11.2017 passed in Cr.Misc.No.44560 of 2017 with direction to learned trial court to expedite the trial and liberty was given to the petitioner to renew his prayer for bail before the court below after recording evidence of informant. Submission of learned counsel for the petitioner is that evidence of informant has been recorded and she has not supported the prosecution case and she has not identified the petitioner but his prayer for bail has again been rejected by the court below and he is in custody since 21.7.2017. Heard learned APP also.
Having heard both sides and in the facts and circumstances, let the petitioner, above named, be released on bail
Patna High Court Cr.Misc. No.14048 of 2018 (2) dt.21-03-2018 2/2 on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of 1st Additional District and Sessions Judge-cumSpecial Judge, West Champaran, Bettiah, in connection with S.G.R. No. 44 of 2017, arising out of Shikarpur P.S.Case No. 319 of 2017, subject to the conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and (2) petitioner shall cooperate in trial and appear before the court as and when required, except on genuine ground, failing which his bail bond shall be cancelled.
