The petitioner apprehends his arrest in a criminal prosecution registered under Section 307 and some other allied offences under the Indian Penal Code.

Taking into consideration the fact that the petitioner is the sole accused named in the FIR vide Annexure-1 as an accused and further taking into consideration the fact that he is alleged to have assaulted by lathi on the different parts of the body of the informant as a result of which he sustained multiple injuries, out of which two injuries have been opined to be grievous in nature, which is apparent from Annexure-2 series, this Court is not inclined to accede to the prayer made on behalf of the petitioner for grant of anticipatory bail. Accordingly, his prayer for grant of anticipatory bail in connection with Ramgarh (Nuaon) P.S. Case No.03 of 2016 pending in the court of learned A.C.J.M., Bhabhua (Kaimur) is rejected.

However, if the petitioner surrenders in the court below within a period of four weeks from today and applies for

Patna High Court Cr.Misc. No.11663 of 2016 (2) dt.16-03-2016 regular bail, then the same shall be considered and decided on its own merits without being prejudiced by the present order. (Birendra Prasad Verma, J) Arvind/- U T
