The petitioner seeks bail in Muffasil P.S. Case No. 75 of 2017 registered for the offences punishable under Sections 304, 307, 325, 436 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act.
The informant made specific allegation that Srirup Das assaulted his brother Indrajit Das on his nose. Madan Mohan Das assaulted the informant Kanhaiya Das with iron rod on his head. Manohar Das assaulted the father of the informant. All the accused persons set ablaze the house of the informant. It is alleged that thereafter other accused persons and the petitioner also came and assaulted his father, brother and others.
Learned counsel for the petitioner submits that three
Patna High Court Cr.Misc. No.28155 of 2017 (2) dt.03-07-2017 2/2 persons namely Chotan Das, Kanheiya Das and Munna Das got injuries. The petitioners are not the assailants. There is a counter version.
Considering the facts aforesaid the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in Muffasil P.S. Case No. 75 of 2017. (Prabhat Kumar Jha, J.) KKSINHA/- U T
