JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 19-05-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Sabaur (Goradih) P.S. Case No. 444 of 2022, registered for the offences punishable under Sections 30(a), 32(i),(ii), 41 of Bihar Prohibition and Excise Act 2018.

The learned counsel for the petitioner has submitted that two vehicles were intercepted by the police and the petitioner is driver of the vehicle, wherefrom 711 liters of foreign liquor was recovered. He is a person of clean antecedent and is under custody since 21.10.2023.

On the other hand, the learned APP has opposed the prayer for bail.

No.14048 of 2023(2) dt.19-05-2023 2/2 Considering the above-mentioned facts and circumstances as well as clean antecedent and the period of custody, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Special Judge Exclusive Excise Court No. 2, Bhagalpur in connection with Sabaur (Goradih) P.S. Case No. 444 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
