The petitioner is languishing in custody since 12.06.2018 in connection with Majhaulia P.S. Case No.230 of 2018 registered for the offences punishable under Sections 489(A), 489(B), 489(C), 489(D)/34 of the Indian Penal Code. Prosecution case as per the written report of Om Prakash Chauhan, S.H.O. of Majhaulia P.S. is to the effect that on 11.06.2018 at 5.30 A.M., a secret information was received that a male and female are dealing with the fake currency notes and are looking for their customers. Consequently, raid was laid and two persons were apprehended including this petitioner. From the possession of the petitioner, 33 pieces of fake currency note of Rs.2000/- each were recovered whereas from possession
Patna High Court CR. MISC. No.13340 of 2019(2) dt.07-03-2019 2/2 of co-accused, Brajesh Sahni, ten pieces of fake currency notes were recovered.
It is submitted by learned counsel for the petitioner that even assuming the accusation to be true, the offence under Section 4 of the IPC is not made out.
Learned A.P.P. submits that in view of their admission by which petitioner and co-accused used to print and used to sell fake currency note, as such that the case under Section 489 (A), 489(B) and 489© of the IPC is made out.
Considering the fact that petitioner is a lady and has never been accused in similar nature though she is accused in other cases and the fact that investigation has already concluded, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, District-West Champaran in connection with Majhaulia P.S. Case No.230 of 2018.
