The petitioner is in custody in connection with Forbesganj P.S. Case No. 559 of 2017, corresponding to S.T. No. 223 of 2018, registered for the offence punishable under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that nothing was recovered from the possession of the petitioner. He further submits that in the instant case the name of the petitioner surfaced on the confessional statement of co-accused Bechan Ansari @ Bechan Mian. Learned counsel for the petitioner would submit that petitioner is in custody since 16.01.2018. Considering the fact petitioner has remained in

No.13618 of 2019(2) dt.06-03-2019 2/2 custody nearly 14 months and the name of the petitioner surfaced on the confessional statement of the co-accused, the Court is inclined to grant bail to the petitioner. Let, the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned 3rd Additional Sessions Judge-Araria, in connection with Forbesganj P.S. Case No. 559 of 2017, corresponding to S.T. No. 223 of 2018.
