Heard learned counsel for the petitioner and the State. The petitioner prays for grant of bail in Nadi P.S. Case no. 154/2020 corresponding to Special Case no. 142/2020 registered for the offence punishable under sections 8(iii), 20(b)(ii)(c), 22(c) of NDPS Act.

As per prosecution case, 5 kg Ganja has been recovered from plastic bag which was thrown by accused persons including this petitioner.

It is submitted on behalf of petitioner that no incriminating article has been recovered from the possession of petitioner. Petitioner has got clean antecedent and is in custody since 21.09.2020. Investigation is complete.

Considering the fact that huge quantity of narcotic has been recovered, prayer for bail of the petitioner is rejected. However, once charge is framed, trial court (Addl. Sessions Judge XVI, Patna) is directed to release the petitioner on bail on furnishing bail bonds fixed by the court below itself to its satisfaction.
