JUSTICE ARUN KUMAR ORAL ORDER 10-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 14.11.2017, seeks bail in Darbhanga Sadar PS Case No. 436 of 2017 registered under Section 414 of the IPC and Section 25(1-b)a, 26 and 35 of the Arms Act. The allegation in brief is that one country made pistol and two live cartridges were recovered from the possession of the petitioner.

Submission is that the petitioner has falsely been implicated at the behest of his enemies who are agnates and had lodged two cases against him earlier, except that there is no other criminal antecedent against the petitioner and he is in custody in this case since 14.11.2017.

Having considered the said facts and circumstances, the petitioner, namely, Sanjay Sahni is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Darbhanga in connection with Darbhanga Sadar PS Case No. 436 of 2017.
