Petitioner seeks bail in a Rahui (vena) PS Case No. 425 of 2020 for the offences punishable under Sections 363, 365/34 of the IPC.

Allegation against the petitioner is of kidnapping the daughter of the Informant along with FIR named accused. It has been submitted on behalf of petitioner that he is innocent and has been falsely implicated in this case. It has been further submitted by learned counsel for the petitioner that there is contradiction in the statement of the victim girl recorded under Section 161 of Cr.P.C and 164 of Cr.P.C. Petitioner is in custody since 30.11.2020.

Considering the fact that the victim girl in her statement

No.23826 of 2021(3) dt.23-06-2021 2/2 recorded under Section 164 of Cr.P.C has stated that petitioner has taken his mobile phone and demanded ransom of Rs. 1,50,000/- from her father, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected.

However, it is observed that petitioner would be at liberty to renew his prayer for bail after framing of charge. (S. Kumar, J) ranjan/- U
