The petitioner apprehends his arrest in connection with Thawe P.S. Case No. 141 of 2019 for the offence under Section 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2018.

In the instant case total 16.400 litres of liquor was seized.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He further submits that the recovery was made from the house of Shyam Bihari Sah and not from the house or possession of the petitioner. Considering the aforesaid, the petitioner named above, in the event of arrest or surrender before the court below

Patna High Court CR. MISC. No.11954 of 2020(2) dt.05-03-2020 2/2 within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum- Special Judge, Excise Act, Gopalganj in connection with Thawe P.S. Case No. 141 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
