Petitioner no.1 is mother-in-law whereas petitioner no.2 is younger brother-in-law of the deceased and they apprehend their arrest in connection with Matihani P. S. case no. 13/2014. Originally, complaint bearing Complaint Case No. 2105C of 2013 was filed by the informant on 23.9.2013 and the present FIR was registered under section 302/34 of the IPC on the basis of the aforesaid complaint case.
Admittedly, deceased died on 12.9.2013 and on the same day, father-in-law of the deceased lodged UD case no. 8/2013. Moreover, it would appear from perusal of the impugned order of learned Sessions Judge that police, after due investigation, submitted charge sheet for the offence punishable under section 306/34 of the
Patna High Court Cr.Misc. No.4850 of 2015 (2) dt.05-02-2015 IPC.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of Sri Prakash, Judicial Magistrate, Ist Class, Begusarai/concerned court in Matihani P. S. case no. 13/2014 subject to condition as laid down under section 438(2) of the Cr.P.C. shahid (Hemant Kumar Srivastava,J) U T
