JUSTICE ARUN KUMAR ORAL ORDER 11-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 6.1.2018, seeks bail in Bahadurganj PS Case No. 24 of 2017 registered under Sections 366A and 372/34 of the IPC.

The allegation in brief is that the informant developed acquaintance with the petitioner for few months and eloped with him, this petitioner sent the informant to Araria with Firoj, suspecting some ulterior motive she raised alarm when Firojh was apprehended.

Learned Counsel for the petitioner submits that as per the allegation itself it appears that it is a case of elopement, the girl is also major above 18 years of age and she has not made any allegation of committing any sexual assault against the petitioner. Having considered the said facts and circumstances, the petitioner, namely, Jisan @ Imtiyaz Alam is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Kishanganj in connection with Bahadurganj PS Case No. 24 of 2017.
