The petitioner has renewed his prayer for bail in a case registered under section 307 and other sections of the Indian Penal Code.

As per the prosecution case, the petitioner is said to have assaulted Jai Prakash with a sword on his head and the informant with gupti on his cheek.

It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 24.8.2021 passed in Cr. Misc. no.14193 of 2021 giving liberty to the petitioner to renew his prayer for bail after six months. It has been more than six months since the earlier order of rejection dated 24.8.2021. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the liberty granted by the aforesaid order of rejection dated 24.8.2021 and the petitioner having remained in custody for more than 1 year 3 months, the Court directs the petitioner to be enlarged on bail in connection with Garkha P.S. Case no.168 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra.
