The petitioner Rajesh Kunwar apprehends his arrest in Mufassil P.S. Case No. 45 of 2014, registered for the offences punishable under Section 302 of the Indian Penal Code and Section 27 of the Arms Act. The FIR is lodged against unknown after recovery of dead body of Kanhaiya Kunwar. Learned counsel for the petitioner submits that during the course of investigation the name of the petitioner along with other accused persons figured in the case on mere suspicion. Coaccused Karu Kunwar and Lachhman Mishra have been granted anticipatory bail vide order passed in Cr. Misc. No. 29170 of 2014 and 30729 of 2014 and the case of the petitioner stands on same footing.
Patna High Court Cr.Misc. No.3722 of 2015 (2) dt.28-01-2015 Considering the facts aforesaid and the fact that similarly situated accused have already been granted anticipatory bail, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Munger in connection with Muffasil P.S. Case No. 45 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
