ANJANA MISHRA ORAL ORDER 20-02-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 28.10.2017 in connection Adapur P.S. Case No.191 of 2017 registered for the offence under Sections 341, 323, 379, 376/511, 504 and 506 of the Indian Penal Code.

Learned counsel for the petitioner submits that the entire allegation is false and mischievous and has been engineered by the opposite party no.2 only to wreak vengeance on him. It is submitted that no such occurrence ever took place and the evidence of the same has come on the record of the case diary.

No.5154 of 2018 (3) dt.20-02-2018 2/2 Learned counsel appearing on behalf of the State after perusal of the case diary submits that earlier there was some illicit relation between the petitioner and the opposite party no.2 but thereafter, when the villagers came to know about the same, she pursued them not to raise any hue and cry and that it would not happen in future. It is only a sequel to such agreement with the villagers, that she filed the present case against the petitioner.

Considering the entire facts and circumstances and the peculiar nature of allegations made by the informant, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Raxaul at Motihari (East Champaran), in connection with Adapur P.S. Case No.191 of 2017.
