The petitioner, who is in custody since 08.01.2020 and is a person of 70 years of age, seeks bail in connection with Motipur P. S. Case No. 10 of 2019 dated 04.01.2019 for the offence instituted under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It appears from the records that 98.625 litres of liquor has been recovered from the fodder house of

Patna High Court CR. MISC. No.12666 of 2020(2) dt.06-03-2020 2/2 the petitioner.

Learned counsel for the petitioner submits that though the fodder house belongs to him but it is open from all sides and is accessible to anybody.

Considering the nature of accusation against the petitioner, his age and the period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Muzaffarpur in connection with Motipur P. S. Case No. 10 of 2019. While saying so, the Court has also taken note of the fact that there is no criminal case pending against the petitioner apart from this.
