Petitioner, already in custody, seeks bail in connection with Maheshkhunt P.S. Case No.132 of 2017 registered under Sections 302, 201/34 of the Indian Penal Code. Allegation in brief is that the sister of the informant was married with the petitioner 15 years back and one fine morning the petitioner informed the informant that his wife is missing and later on learnt from the villagers that her dead body was found on the railway track and the accused persons disposed of the dead body.

Learned counsel for the petitioner submits that the marriage was solemnized 15 years back, there are two children out of the wedlock and the deceased committed suicide,

Patna High Court Cr.Misc. No.21261 of 2018(2) dt.12-04-2018 2/2 moreover other co-accused Gayatri Devi and others have been admitted to bail by a coordinate Bench of this Court vide Cr. Misc. No.16633 of 2018 on 23.03.2018 and there is no direct evidence against the petitioner.

Having considered the aforesaid facts and circumstances, petitioner Sanjit Muni @ Sujit Muni is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, 3rd, Khagaria in connection with Maheshkhunt P.S. Case No.132 of 2017 with condition that the petitioner shall remain physically present on each and every date before the trial court as and when required and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled.
