Mr.Ansar Ul Haque ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-03-2019 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Aurai P.S. Case No. 264 of 2018 for the offences punishable under Sections 413, 414 and 34 of the Indian Penal Code . The allegation is regarding the informant having lodged a case against the petitioner herein and others alleging therein that in the night on 19.11.2018 at about 2.45 A.M. he received information that in village Bishanpur Jagdish, one Dev Chandra Rai was engaging in selling and purchasing of stolen motorcycle, whereafter the police official had raided the house of the said Dev Chandra Rai and recovered a stolen motorcycle and it is the said accused Dev Chandra Rai, who had disclosed

Patna High Court CR. MISC. No.13195 of 2019(2) dt.05-03-2019 2/2 that the said motorcycle was handed over to him by the petitioner and one other accused person, namely, Abdul Kalam. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and in fact, no stolen motorcycle was recovered either from the conscious possession of the petitioner or from the house of the petitioner. It is further submitted that though the petitioner is an accused in one other case, but he is on bail in the said case. The petitioner is stated to be languishing in custody since 20.11.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Sub-Judge XIV cum ACJM-XIII, Muzaffarpur in connection with Aurai P.S. Case No. 264 of 2018.
