JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code.
The name of the petitioner sprang up on the confession of co-accused.
It is submitted by learned counsel for the petitioner that co-accused, on whose confession the name of the petitioner surfaced, has been acquitted vide S. Tr. No. 184 of 2010. The aforesaid facts may constitute ground for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Araria P.S. Case No. 425 of 2009
Patna High Court Cr.Misc. No.4765 of 2015 (2) dt.05-02-2015 2/2 pending in the court of learned CJM, Araria.
Accordingly, the application is disposed of.
