====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 06-07-2022 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Lauriya P.S. Case No. 288 of 2021 lodged under Sections 346, 363, 366A, 370A, 372, 373, 354, 504, 506/34 of the Indian Penal Code, under Sections 3, 4, 5, 6, 7 and 8 of Immoral Traffic (Prevention) Act and Sections 8, 12 and 17 of POCSO Act.
It has been alleged in the F.I.R. that petitioner and five others used to run Orchestra Group and used to call the female child and exploited the girl.
Learned counsel for the petitioner submits that there is no allegation of human trafficking or POCSO in the present case. He further submits that petitioner is in custody since
Patna High Court CR. MISC. No.14682 of 2022(2) dt.06-07-2022 2/2 19.11.2021 and charge sheet has already been filed. He further submits that petitioner has no criminal antecedent. Learned counsel for the petitioner further submits that he is not involved in the management of the Orchestra group, rather he is one of artist like other persons including those who are alleged to be victim in the present case.
Learned A.P.P. has opposed the prayer for bail. Considering the facts and circumstances that petitioner is himself an artist working in the Orchestra group, he is in custody since 19.11.2021 having clean antecedent and charge sheet has already been filed in this case, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District & Sessions Judge-VII-cum- Special Judge, POCSO, Bettiah, West Champaran in connection with Lauriya P.S. Case No. 288 of 2021, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure.
