JUSTICE SUDHIR SINGH ORAL ORDER 21-05-2015 The petitioners are apprehending their arrest in connection with Siwan (Town) P.S.Case No. 413 of 2014 instituted under Sections 304B, 201/34 of the Indian Penal Code. Heard learned counsel for the petitioners and the State. The informant, who happens to be the brother of the deceased lodged a written report before the police that her sister was married to one Rajan Sah about eight months back and after few days of marriage of her sister she used to tell her on phone that her-in-laws used to assault and torture her for bringing money from his parents. It has been further alleged that few days ago the deceased came to her Maike but her husband Rajan Sah came and prayed her parent for making Bidai and on that pretext
Patna High Court Cr.Misc. No.3677 of 2015 (5) dt.21-05-2015 2/3 he took away the deceased with him. On 3.10.2014 the sister of the informant telephonically informed that all the accused persons are not talking to her and there planning to do something and subsequently in the next morning i.e. on 4.10.2014 the informant got an information that her sister Neelam Devi has died and thereof all the accused persons are absconding. Even the dead body of the deceased is disposed of in haste. It has been submitted on behalf of the petitioners that petitioner no.1 is the father-in-law and petitioner no.2 is the mother-in-law of the deceased. Further it has been submitted that the petitioners have falsely been implicated in the present case. It is also submitted that the petitioners have no concern with the present incident. It is also submitted that the husband of the deceased is in judicial custody.
On behalf of the State, it has been submitted that the petitioners are named in the FIR.
Considering the fact that the husband of the deceased is in judicial custody, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of eight weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Siwan in connection with Siwan
