1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Matihani P.S. Case no.152 of 2022 registered under section 8(C) of the N.D.P.S. Act.

3. As per the prosecution case, 1.2 kgs of ganja was recovered hidden in the house of the petitioner.

4. Learned counsel for the petitioner submits that no incriminating article has been recovered from his possession or from his house. He has been falsely implicated in the case. The petitioner is in custody since 14.11.2022 and has no criminal antecedent.

5. Heard learned A.P.P. for the State.

6. Having heard learned counsel for the parties and

No.14309 of 2023(2) dt.15-05-2023 2/2 taking into consideration the nature of allegation, the petitioner having remained in custody for 6 months since 14.11.2022, his not having any criminal antecedent and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Matihani P.S. Case no.152 of 2022 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge, Begusarai.
