JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 01-04-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. On confidential information, raid was conducted, during course thereof, from the house of Ajay Paswan 50 litres of country made wine, from the house of both these two petitioners, 125 litres of country made wine and from the house of Chunchun Paswan, 40 litres of country made wine were seized. From the seizure list, it is evident that it does not bear signature of any of the family members nor any independent witness has been shown.
In the aforesaid background, petitioners, namely, Shambhu Paswan and Jalo Paswan independently are directed to be released on bail in the event of their arrest/surrender within six
Patna High Court Cr.Misc. No.12441 of 2016 (2) dt.01-04-2016 2/2 weeks from the date of production/receipt of the order on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Jamui in connection with Jhajha P.S. Case No. 214 of 2015 in terms of the condition as enumerated under Section 438(2) of the Cr.P.C.
