Petitioner apprehends arrest in connection with Mahkar P.S. Case No. 55 of 2020 registered for the offence punishable under section 307 and other allied sections of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. No specific allegation is attributed against this petitioner. As a matter of fact, the present complaint has been filed merely because the brother of this petitioner had lodged a complain against the present informant vide Annexure-2. Petitioner is a school teacher and on the date
Patna High Court CR. MISC. No.23910 of 2021(2) dt.04-02-2022 2/2 and time of the alleged occurrence he was present at the school as would be evident from the Attendance Register enclosed as Annexure-3. Petitioner has no criminal antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing personal bond to the satisfaction of Additional Chief Judicial Magistrate, IX, Gaya in connection with Mahkar P.S. Case No. 55 of 2020 subject to the conditions laid down under section 438(2) Cr.P.C. (Arvind Srivastava, J) mcv/- U T
