2. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 147, 149, 341, 323, 324, 325, 307, 354B, 379, 504 and 506 of the Indian Penal Code.
3. The prosecution case in brief is that informant namely Kanchan Kumari alleged that on 30.11.2023 around 2 P.M., all the seven accused persons named in the F.I.R. including this petitioner were forcibly trying to occupy the residential courtyard of the informant. Accused Anju Devi was trying to place the clay stove inside her courtyard and when the mother of the informant objected, this petitioner pushed mother of the informant on the ground disrobed her and also assaulted
Patna High Court CR. MISC. No.15067 of 2025(2) dt.07-04-2025 2/2 on her private part with shoe. It is further alleged that this petitioner also assaulted Pintu Yadav with sword on his head causing serious injury.
4. Learned counsel for the petitioner submits that allegation of assault is general and omnibus and he has falsely been implicated in this case because of land dispute between the parties. Petitioner is the father of the informant of this case. He further submits that the present case is counter blast of Jadia P.S. Case No. 294 of 2023 which was lodged by wife of the petitioner against father and brother of the informant.
5. Learned A.P.P. for the State opposes and submitted that there is specific allegation against this petitioner of causing assault on the private part of the mother of the informant by shoe. Petitioner has got two criminal antecedents.
6. Considering the nature of allegation and the criminal antecedents, the prayer for anticipatory bail of the petitioner is rejected.
