The petitioner seeks regular bail in connection with Kurtha P.S. Case No. 119 of 2016 registered for the offences punishable under sections 304 (B), 201/34 of the IPC. Earlier the prayer for regular bail was rejected vide order dated 16.01.2017 passed in Cr. Misc. Case No. 54726 of 2016 by this Court with a direction to the trial court to expedite the trial and try to conclude it as soon as possible but the trial court has not taken necessary step and till today the trial is yet to be completed.
Learned APP opposes the prayer for bail.
Having heard both sides, in view of the facts and
Patna High Court Cr.Misc. No.30554 of 2017 (3) dt.02-08-2017 2/2 circumstances, I am not inclined to enlarge the petitioner on bail and accordingly his prayer stands rejected.
However, the trial court is directed to expedite the trial and try to conclude it as soon as possible preferably within a period of nine months.
With the above observation, this application is dismissed.
