JUSTICE ARUN KUMAR ORAL ORDER 03-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 14.12.2017, seeks bail in Sheosagar (Buddi) PS Case No. 366 of 2017 registered under Sections 25(1-b)a, 26 and 35 of the IPC.
The allegation in brief is that one country made pistol and ten live cartridges were recovered from the possession of the petitioner.
Learned Counsel for the petitioner submits that the petitioner has been implicated in this case as the police wanted him to act as police informer but he refused.
Whereas learned Counsel for the State submits that there is recovery of arms and ten live cartridges and the petitioner has also two criminal antecedent.
Having considered the aforesaid facts and circumstances, particularly the criminal antecedent, the prayer for bail of the petitioner is presently rejected.
The trial court is directed to expedite the trial and preferably conclude the same within a period of nine months. If the trial is not concluded within the aforesaid period the petitioner may renew his prayer for bail.
