The petitioner apprehends his arrest in connection with Chapra Town P.S. Case No. 17 of 2020 registered for the offence under Sections 30(a), 41(i), (ii) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the petitioner has been made accused in this case merely on the basis of confessional statement of the co-accused. Nothing has been recovered from the conscious possession of the petitioner. The alleged recovery has been made from Tata 407 which has no concern with the

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing of personal bond to the satisfaction of learned A.D.J.-II -cum- Special Judge, Excise, Saran in connection with Chapra Town P.S. Case No. 17 of 2020 subject to the conditions laid down under Section 438(2) Cr.P.C. (Arvind Srivastava, J) brajesh/- U T
