2. The petitioner seeks bail in connection with Kanti PS Case No. 672 of 2023 instituted for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.

3. As per the prosecution case, it is case of murder of the daughter of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case due to dirty village politics. Petitioner is the Bhaisur of the deceased. The allegation against the petitioner and other co-accused is that he has committed murder of the daughter of the informant and the dead body of the deceased was disposed of in funeral without any information

Patna High Court CR. MISC. No.18046 of 2024(2) dt.14-03-2024 2/2 to the informant. Petitioner is in custody since 31.08.2023.

5. Learned APP opposes the prayer for bail.

From perusal of the FIR and impugned order of the learned Additional Sessions Judge-17, Muzaffarpur dated 05.01.2024, it appears that petitioner is named in the FIR and the allegation against the petitioner and his family members are that they murdered the daughter of the informant. From perusal of the certify copy of the joint compromise petition at page-15 dated 30.08.2023, both parties have entered into a compromise and compromise petition is already on record and her signature and LTI has also been identified by the concerned persons, accordingly the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Muzaffarpur (West) in connection with Kanti PS Case No. 672 of 2023.
