JUSTICE SHIVAJI PANDEY ORAL JUDGMENT Date: 28-03-2017 Heard learned counsel for the petitioner and counsel for the State.

In the present case, the petitioner is seeking release of an amount of Rs.8,05,500/-.

As per the case of the petitioner, the petitioner has entered into an agreement bearing Agreement No. 432 F2 of 2014-15 Value Rs. 8,18,921/- and also entered into an agreement bearing Agreement No. 7 F2 of 2014-15 Value Rs. 9,96,169/-. As per claim of the petitioner, he has completed both the works under the time frame, certain running bills have been made but he is still entitled to Rs. 8,05,500/- which has not been paid to the petitioner.

The Executive Engineer, Building Construction

Patna High Court CWJC No.19595 of 2016 dt.28-03-2017 Department has been requested by the petitioner to release the said amount. The petitioner has approached to the aforesaid authority several times without any success.

In that view of the matter, let the petitioner file a detailed representation with supporting document along with a copy of this order before the Engineer-in-Chief cum Special Secretary, Building Construction Department, Bihar, Patna who will be obliged to examine the case of the petitioner and if it is found that the petitioner is entitled to the aforesaid amount, the same should be released without delay.

If the petitioner files a representation before the aforesaid authority, the same should be disposed of within a period of two weeks from the date of filing of the representation by the petitioner and if the petitioner is found entitled for the amount, the same should be released in his favour within a period of one month thereafter.

With the aforementioned observation and direction, this application is disposed of.
