ANJANA PRAKASH ORAL ORDER 03-03-2016 The petitioner seeks quashing of the order dated 13.03.2014 passed by the 3rd Additional Sessions Judge, Muzaffarpur in connection with Sessions Trial No. 144 of 2010 arising out of Motipur P.S. case No.108 of 2009.

Considering that the petitioner is facing trial under section 304B of the IPC, it would be in the interest of justice that PW 2, 4 and 5 be recalled for cross-examination within four weeks from the date of receipt of this order. However, the court below shall not give more than one indulgence for examination of three witnesses.

With the aforesaid observation, this application stands disposed of.
