Grievance of the petitioner in this case is that he has applied for arms licence and even recommendation of the police was there but till date no final decision has been taken by the licensing authority. However, it appears that though the report was prepared on 12.02.2014 but it could not be communicated to the licensing authority.

The Senior Superintendent of Police, Patna is present along with the Officer-in-Charge of Danapur Police Station. A counter affidavit has been filed disclosing the action which has been taken in view of the negligence on part of the concerned employee and a disciplinary proceeding has already

Patna High Court CWJC No.1919 of 2015 (5) dt.21-08-2015 been initiated. This Court would not proceed in the aforesaid matter at this stage. It is also submitted that the report has already been sent to the licensing authority and that has also been received by it.

Having regard to the facts and circumstances of the case, this Court is inclined to dispose of the writ application directing the licensing authority to take final decision in the case of the petitioner within a period of eight weeks from the date of receipt/production of a copy of this order on its own merit and in accordance with law.

The personal appearance of the Officers is dispensed with.
