In this case, the petitioner is seeking anticipatory bail in connection with Mashrak P.S. Case No.211 of 2019, registered for the offence punishable under Sections 272/273 of the Indian Penal Code and Sections 30/30 (a)/38/41 of Bihar Prohibition and Excise Act, 2016.
The police has recovered 5.400 literes of country made liquor from the house of co-accused Kanhaiya Kumar Singh, who has been apprehended from the spot and has disclosed that he used to bring the liquor from the present petitioner. In paragraph 3 of the bail petition, it has been stated that the petitioner has also involved in six other criminal cases.
Patna High Court CR. MISC. No.13722 of 2020(4) dt.11-12-2020 2/2 Looking to the entire facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within six weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
