The petitioner seeks bail in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307, 447, 504, 506 and 325 of the Indian Penal Code and under Section 27 of the Arms Act.

Allegation against the petitioner in collusion with other accused persons is said to have assaulted the informant and his family members by means of deadly weapons. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He submits that there is general and omnibus allegation against the petitioner and there is no specific overt act against the petitioner. The allegation against the accused persons is that who assaulted by country made rifle and Nalkatua and the injury

Patna High Court CR. MISC. No.24651 of 2021(4) dt.28-10-2021 2/2 of the injured person is simple in nature. The petitioner is languishing in judicial custody since 22.12.2020. The petitioner has got 02 criminal antecedents, which is mentioned in para 3 of the bail petition. The similarly situated co-accused has been granted bail by a co-ordinate Bench of this Court vide order dated 30.04.2021 passed in Cr. Misc. No.8735/2021. Learned APP for the State vehemently opposed the prayer for bail application and submits that as per case diary three persons got sustained injured in the alleged commission of offence, in which one of injured received firearm injury whereas another two injured received several injuries on their various part of the body.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each in connection with Kinjer P.S. Case No. 44/2020 to the satisfaction of learned Court below where the case is pending/ successor Court.
