2. The petitioner seeks regular bail in connection with Sahiyara P.S. Case No. 118 of 2024 registered for the offence under Sections 191(3), 191(2), 190, 329(3), 126(2), 115(2), 75, 76, 103(1), 352, 351(2), 351(3) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, there is general and omnibus allegation against six accused persons of assaulting the victim with lathi danda etc. Only one injury has been found on the dead body of the deceased.

4. Learned senior counsel for the petitioner submits

Patna High Court CR. MISC. No.13480 of 2025(3) dt.13-05-2025 2/2 that there is general and omnibus allegation against the petitioner and the petitioner is in custody since 14.09.2024. He further submits that the prosecution case is not supported by the Post-Mortem report.

5. Learned counsel for the informant has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District Judge-II, Sitamarhi/concerned Court below in connection with Sahiyara P.S. Case No. 118 of 2024 subject to condition that:- (i). The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and noncooperation in the trial shall result in cancellation of the bail bonds of the petitioner.
