2. The petitioner is in custody since 23.11.2017 in connection with Khagaria (R.P.F.) P.S. Case No. 05 of 2017 for the offences alleged under Section 3 of the Railway Property (Unlawful Possession) Act.
3. It is submitted that the petitioner has been falsely implicated and no recovery of any incriminating articles has been made from the possession of the petitioner.
4. Learned APP for the State opposes the prayer for bail.
5. Considering that the petitioner was apprehended while fleeing away from the spot where he along with co-accused had been collecting the bundles of theft article of the railway as well as his criminal antecedents there being three cases of similar nature registered against the petitioner from which it is apparent that he is a habitual offender, this Court is not inclined to grant privilege of bail to the petitioner. The bail petition stands
