The petitioner seeks bail in Araria P.S. Case No. 23 of 2016 registered under Section 395 of the Indian Penal Code and Section 27 of the Arms Act.

Some unknown miscreants are said to have looted cash of Rs. 95,000/-, three cartons of mobil, etc. from the petrol pump of which the informant is the manger.

It is submitted by learned counsel for the petitioner that the petitioner is not named in the F.I.R. Nothing incriminating article has been recovered from his conscious physical possession. His name has surfaced in the case on the basis of the confessional statement of co-accused, namely, Amit Kumar who has been enlarged on bail by a co-ordinate bench of this court vide order

Patna High Court Cr.Misc. No.33923 of 2017 (2) dt.20-07-2017 2/2 dated 05.07.2016 passed in Cr. Misc. No. 26187 of 2016. The petitioner has been languishing in custody since 18.05.2017. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 23 of 2016.
