JUSTICE ARUN KUMAR ORAL ORDER 09-04-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Ishakchak P.S.Case No. 55 of 2017 registered under Sections 307, 326, 384, 386 and 120B of the Indian penal Code and 3 and 4 of the Explosive Substance Act.

Allegation in brief is that accused persons have formed a criminal gang and used to make demand of extortion from the informant and created terror by exploding bombs by the side of the Railway track.

Submission is that allegation is of petitioner being a member of the criminal gang but he has no criminal antecedent and none of the mobile numbers mentioned in the FIR belong to petitioner and similarly situated co-accused persons namely Md. Jasim, Md. Salauddin, Md. Nabbi MIya and Md. Akbar have been

No.11917 of 2018 (3) dt.09-04-2018 2/2 admitted to bail by the co-ordinate Benches of this Court vide order dated 19.09.2017, 17.11.2017, 06.02.2018 and 12.01.2018 passed in Cr. Misc. No. 38952 of 2017, Cr.Misc. No. 48845 of 2017, Cr. Misc. No. 1431 of 2018 and Cr. Misc. No. 1921 of 2018 respectively.

Having considered the aforesaid facts and circumstances, in particular, similarly situated co-accused persons have been admitted to bail, so the petitioner, namely, Md. Banti is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Mr. P.C.Verma, ACJM-6th, Bhagalpur in connection with Ishakchak P.S. Case No. 55 of 2017.
