JUSTICE SUDHIR SINGH ORAL ORDER 21-05-2015 The petitioner is apprehending his arrest in connection with Singhwara P.S.Case No. 88/2014 instituted under Sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code. Heard learned counsel for the petitioner and the State. There is allegation that the petitioner gave a Kudal blow upon the head of the informant. The informant sustained injuries. It is further alleged that the petitioner and co accused Ram Prasad Das further assaulted the informant by means of lathi. Binay Das also arrived there to save the informant but who was also assaulted by means of lathi by the petitioner. It is also alleged that other accused persons also assaulted Binay Das by means of bricks. The accused Rajendra Das also took away Rs. 1000/- from the pocket of the informant.
Patna High Court Cr.Misc. No.3880 of 2015 (3) dt.21-05-2015 2/2 It has been submitted on behalf of the petitioner that there is a case and counter case. The dispute arose for petty reason and both sides have sustained injuries. Further it has been submitted that from perusal of the impugned it appears that the injuries caused by the accused are simple in nature. It is also submitted that the petitioner has no criminal antecedent. On behalf of the State it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of eight weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Darbhanga in connection with Singhwara P.S.Case No. 88 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C. (Sudhir Singh, J) singh/- U
